SMASH SURF FILM FESTIVAL RULES AND REGULATIONS

  1. Film Must be at least 30min long to be considered a feature length surf film.
  2. Deadline: May 20th, 2013
  3. SMASH Surf Film Festival accepts submissions for features, documentaries, animation, experimental, and shred flicks.
  4. All films submitted must have been completed on or after January 1, 2012.
  5. All films must be submitted Digitally either through Vimeo or an HD Digital file. Films must be submitted via password protected online link (Vimeo, for example.)
  6. All feature narratives and feature documentaries must be over 30 minutes in length.
  7. Animated, experimental and student films of Feature will be considered.
  8. Short films will not be accepted at this year’s festival.
  9. All filmmakers must have an exhibition format available in at least one of the following: DVD, Blu-Ray or HD File.
  10. All HD files must be in the following quicktime formats (.mov): ApplePro Res or H.264.
  11. No Other Format will be accepted
  12. Submissions can be made online through SMASH’s website.
  13. Filmmakers will be notified of their submission status by approximately June 15th, 2013.
  14. Please do not send press kits unless otherwise requested
  15. All rules and regulations must be read prior to submission
  16. All person or persons submitting must hold all necessary rights for the submission of the film, as well as all necessary clearances for public exhibition.
  17. It is the sole responsibility of the Applicant to secure authorization and permission from the copyright owner(s) of any and all copyrighted content or materials included within the submitted Film. SMASH expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any copyrighted content or materials within or relating to the submitted Film, including any content or materials that are or may become the basis for any third party claims for copyright infringement. SMASH reserves the right to disqualify any Film with any unauthorized inclusion of copyrighted content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity that alleges that the Film makes unauthorized or unlawful use of any copyrighted content or material, Applicant shall fully indemnify and defend SMASH, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection there with.
  18. It is the sole responsibility of the Applicant to clear all content of the Film from any and all actual or potential legal claims and issues, including, without limitation, claims based upon theories of libel, defamation, invasion of privacy, violation of rights of publicity, theft of trade secrets, breach of confidence, breach of confidential relationship, and breach of express or implied contract (“Third Party Claim(s)”). SMASH expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any content or materials within or relating to the submitted Film that are or may be the basis for any Third Party Claims based upon any of the foregoing legal theories or others. SMASH reserves the right to disqualify any Film that is or may become the subject of any Third Party Claims. In the event that any Third Party Claim(s) shall be asserted by any person or entity, Applicant shall fully indemnify and defend the SMASH, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any and all fees and expenses, including but not limited to attorneys’ fees, that each of any of them may incur in connection therewith.
  19. Applicants submitting Films that contain significant non-English spoken dialogue must provide on-screen English subtitles.
  20. Upon completion of the Festival selection process, SMASH Productions will attempt to contact the Applicant using the contact information provided on the submission form to notify the Applicant of the Film’s acceptance status. SMASH disavows any responsibility for, and will not be held responsible for, any failure to contact the Applicant using the contact information provided on the submission form. It is the sole responsibility of the Applicant to ensure that the contact information provided on the submission form is correct throughout the entirety of the submission period
  21. SMASH Productions has the permission to use excerpts of up to three minutes for promotional purposes unless otherwise noted in an attachment in writing.
  22. 22. Permission is granted to SMASH Productions to use stills, titles, copy, and/or information from the production for promotional purposes.
  23. Permission is granted to SMASH Productions to screen the production at the SMASH Festival event as well as other Festival programs, presentations and/or events.
  24. Permission is granted to SMASH to share filmmakers information with SMASH festival partners unless specify otherwise.
  25. If chosen as an official selection, by submitting, the producer is herby granting permission for SMASH to exhibit Producer’s submission in the SMASH Surf Film Festival.
  26. By entering the SMASH Surf Film Festival or any of its contests, producers are verifying that they understand entry does not guarantee a screening. Additionally, being chosen as an Official Selection does not guarantee a screening in the theater. SMASH may have Official Selections (non-screening) as well as Official Selections (screening).  Decisions are final and at the discretion of SMASH.
  27. The screening committees’ decisions are final.
  28. SMASH reserves the right to make any necessary changes in regulations or 2013 SMASH Surf Film Festival scheduling.
  29. If film is selected to participate in the SMASH Surf Film & Arts Festival, SMASH Productions agrees to split the profits of the selected films screening in a 60/40 split.  60% goes to SMASH Productions, 40% goes to the film producers. If the film being screened is canceled, the Film Producer will not be compensated for any cancelation or promise of film screening.
  30. SMASH Productions reserves to rights to release free Tickets to VIP, Sponsors, Judges etcetera… without compensating the producers.
